What can you claim in a Road Traffic Accident?

One important part of the personal Injury claim process is identifying what you can claim for. This is calculated once you have established who is liable for the accident and obtained independent legal representation. A solicitor is best placed to guide you through this part of a claim.

Your claim entitlement

If you suffer a Road Traffic Accident (RTA) which wasn’t your fault. It could result in:

  • loss of your car
  • suffer serious injuries which limit your ability to attend to work

If you were to have your car damaged in an accident, then you would be entitled to have your car repaired or have the value of your car paid out. However, there are a few questions that arise at this stage:

  • what will you do between the time your car is repaired and the time of the accident?
  • what will you do if you have third party insurance cover only?
  • what would you do if you cannot afford to buy a new car, pay for repairs yourself or hire rental car?
  • how will you get to work?
  • how will you attend to your daily family chores?

Many are unaware of this, but you are entitled to a hire car on a credit basis. This means that if you cannot afford to replace your damaged car you are entitled to hire a vehicle on a credit basis, which means you do not need to pay a penny up front for the replacement vehicle. A credit hire company recommended by your independent legal advisor will provide you with a rental vehicle on credit. You will be able to use this car until such time you are able to either repair your vehicle or you are able to purchase a new vehicle.

As part of your claim, you are entitled to claim that entire credit hire bill from the liable party. This is one example of a claim you are entitled to in the event of an accident for which wasn’t your fault.

Making a claim entitles you to all the consequences of the accident including:

  • compensation for your injuries
  • your damaged items of clothing
  • loss of earnings you suffered as a result of being unable to go to work
  • a holiday you had to cancel due to the accident
  • expenses for additional personal care you required
  • expenses for public travel you had to incur
