A large number of stillbirths happen in otherwise healthy babies and can be preventable. You may feel that the care you received fell below the expected standard and that medical negligence played a part in your stillbirth. Some examples of this regarding pregnancy and labor include:
  • Wrongful or delayed decision-making leads to delayed treatment
  • Misinterpretation of results at check-ups 
  • Missed signs of symptoms and complications 
  • Inadequate monitoring and testing 
  • Failure to refer for further testing
  • Failure to provide oxygen to a baby when deprived during the birth. 
If you feel that medical negligence was a factor resulting in the loss of your baby, you can make a compensation claim. We understand that no amount of money will be able to compensate you for the loss of your child. However, we will work towards obtaining answers from relevant healthcare providers regarding how and why this tragic event occurred. What should I do if I am struggling to cope with deprivation?

We understand this is a very difficult time for you and your family and that it may be difficult to talk about what has happened. 

Sands is a charity that provides support to families suffering from deprivation – https://www.sands.org.uk/ 

Additionally, from the 22nd of February 2024, families who have lost their baby before 24 weeks are now able to apply for a baby loss certificate.

Will I need to attend an inquest?

An inquest is an investigation into the cause of death. Inquests are not usually held for stillbirths unless there are signs of life after the baby was born. You can request for the hospital to undertake an investigation and review what happened.

What costs are involved in making a claim?
  1. Our cases are generally funded on a conditional fee agreement or ‘no win no fee agreement’ This means you do not pay anything upfront and this will deducted from any compensation awarded.

 

However, should you have legal expenses insurance through your household, car, or trade union which covers personal injury claims you may prefer to fund the claim through this means. If you do not have legal expense insurance then ‘no win no fee’ may be the best funding option.
