Family Law FAQs
- What is no-fault divorce?
Since April 2022, couples in England and Wales can divorce without having to prove fault such as adultery or unreasonable behaviour. A sole or joint application is made on the basis that the marriage has broken down irretrievably. The minimum period from application to final divorce order is approximately six months.
- How is property divided in a divorce?
There is no automatic 50/50 split in England and Wales. The court considers a range of factors, including the length of the marriage, each party’s financial needs, contributions made by each party, and the welfare of any children. Our solicitors can advise on what a fair outcome is likely to look like in your specific circumstances.
- How long does a divorce take?
An uncontested divorce typically takes six to nine months from application to final order. Reaching agreement on financial matters and arrangements for children can take longer, particularly if agreement cannot be reached and court proceedings become necessary.
- What is a financial consent order?
A financial consent order is a court order recording the agreed financial settlement between divorcing parties. It is legally binding once approved by the court and provides finality, so that neither party can make future financial claims against the other. Without one, a former spouse can make financial claims even after divorce.
- Are prenuptial agreements legally binding?
Prenuptial agreements are not automatically binding under English law, but courts give significant weight to them provided certain conditions are met. These include that both parties had independent legal advice, made full financial disclosure before signing, and entered the agreement freely without pressure. We advise on all aspects of prenuptial agreements.
- What happens to children during a divorce?
Parents are encouraged to agree arrangements for children between themselves, with or without the support of mediation. If agreement is not possible, the court can make a child arrangements order setting out where the children live and how much time they spend with each parent. The welfare of the children is the court’s primary consideration.
- Can I get a non-molestation order quickly?
Yes. In urgent cases, a non-molestation order can be granted on the same day without notifying the other party (known as a without-notice application). We can advise and act quickly where there is a risk of harm.
- What is a cohabitation agreement and do I need one?
Unmarried couples have very limited legal rights when a relationship ends, regardless of how long they have lived together. A cohabitation agreement sets out how property, finances, and other matters will be handled if the relationship ends. It is strongly advisable for any unmarried couple who own property together or where one party has made a significant financial contribution.
