The beneficiaries of a high-net-worth (HNW) individual’s Estate instructed our firm after an issue arose with the deceased’s Will. Prior to his passing, the individual had asked his solicitor to draft a Will that would take advantage of a very substantial tax exemption. Although the Will was drafted on that basis, the solicitor advised the client that he was married when, in fact, he was not. This mistake prevented the Estate from benefiting from a multi-million-pound tax saving.
