Solicitors’ Failure To Name The Correct Defendant on a Claim Form

The client instructed solicitors to represent them in a claim against a large insurer. However, the solicitors inserted the incorrect name for the defendant insurer on the Claim Form. Upon discovering their error, they amended the Claim Form but failed to file the revised version with the Court. This meant the client had to make an application for relief, which, if unsuccessful, would have prevented the claim and the client would face a very significant adverse costs order. As a result, the client was forced to settle the claim for significantly less than it might otherwise been able to.
