Which acts or legislation is used to bring a data breach claim?
The following legislation has been created to help individuals from data breaches which occur nowadays.

- WP29 Guidelines/ EDPB – the concept of Data Protection Impact Assessment (DPIA) which is essentially a process of building and demonstrating compliance

Are there any limitations for a data breach claim?
There is a 6 year limitation period to bring a data breach claim under the Data Protection Act of 2018.
What is GDPR and how does it protect me?
The GDPR provides the following rights for individuals:
- The right to be informed
- The right of access
- The right to rectification
- The right to erasure
- The right to restrict processing
- The right to data portability
- The right to object
- Rights in relation to automated decision making and profiling.
The GDPR sets out seven key principles:
- Lawfulness, fairness and transparency
- Purpose limitation
- Data minimisation
- Accuracy
- Storage limitation
- Integrity and confidentiality (security)
- Accountability
Failure to comply with these principles leaves the an entity with substantial fines.
Article 83(5)(a) states that infringements of the basic principles for processing personal data are subject to the highest tier of administrative fines.
This could mean a fine of up to €20 million, or 4% of your total worldwide annual turnover, whichever is higher (see Chapter 8: Art. 77-84).
How much compensation will I receive for a data breach claim??
