ILA Solicitors
ndependent Legal Advice (ILA), also sometimes referred to in some instances as an “Etridge letter”, is a service provided for individuals who need advice on contracts or agreements or other such documents, before entering them. A certificate is subsequently provided by an independent solicitor to confirm that the individual is fully aware of the terms stipulated before signing.
They are often requested to ensure a person understands the risks and obligations of a contract to protect the other party from any potential future claims. Without an ILA, individuals may find their contracts unenforceable. As such, they provide reassurance that someone has not been unduly influenced and are aware of an agreement, contract or transaction.
Instances which require independent legal advice
There are a range of circumstances that may require the need for Independent Legal Advice. Instances where ILA may be requested include:
- Employment Settlement Agreements
- Property Settlement Agreements
- Directors Guarantees
- Deeds of Trust
- Joint Borrowers Sole Proprietor Mortgages
The Process of obtaining an ILA
The Solicitor will explain the terms of the agreement to you in simple and non-technical language. They will then sign a certificate which confirms you have received relevant advice and that you signed the document in their presence without any coercion.
The retrieval of ILA may, in some instances, be time sensitive as they tend to happen towards the end of a transaction and therefore often at a critical time. If you have been asked to acquire an ILA we can offer a rapid, effcient and professional turn around service.
