Independent Legal Advice (ILA), also sometimes referred to in some instances as an “Etridge letter”, is a service provided for individuals who need advice on contracts or agreements or other such documents, before entering them. A certificate is subsequently provided by an independent solicitor to confirm that the individual is fully aware of the terms stipulated before signing.
They are often requested to ensure a person understands the risks and obligations of a contract to protect the other party from any potential future claims. Without an ILA, individuals may find their contracts unenforceable. As such, they provide reassurance that someone has not been unduly influenced and are aware of an agreement, contract or transaction.
