Solicitor Failure to Advise on After the Event Insurance

The client instructed solicitors to represent him in a substantial claim worth approximately £15 million. Whilst the solicitors obtained After the Event insurance, they failed to advise the client that the policy contained a particularly onerous clause. This clause severely limited coverage for adverse costs, leaving the client only partially protected when he eventually lost his claim. As a result of this, the client suffered a loss of approximately £1 million.

Our professional negligence team was instructed to pursue a professional negligence claim against the solicitors. We argued that the failure to adequately advise on the insurance policy constituted a breach of the duty of care owed to the client.

Following the close of pleadings, the parties engaged in mediation. As a result, the professional negligence claim was successfully settled on favourable terms for our client.
