- How long do I have to make a personal injury claim?
The standard limitation period is three years from the date of the accident, or from the date you first knew that your injury was caused by another party’s negligence. For children, the three-year period begins on their 18th birthday. Act promptly: evidence can be lost and witness memories fade.
- What can I claim compensation for?
You can claim for pain, suffering, and loss of amenity (known as general damages) as well as your financial losses (special damages). Special damages include lost earnings, medical treatment and rehabilitation costs, travel expenses, care costs, and any other out-of-pocket expenses caused by the accident.
- What is no win, no fee?
A no win, no fee agreement (formally a conditional fee agreement) means you do not pay our legal fees if your claim is unsuccessful. If you win, a success fee is deducted from your compensation, subject to a statutory cap. We explain all of this clearly before you agree to proceed.
- Do I need to go to court?
Most personal injury claims settle through negotiation before reaching court. However, if the other party disputes liability or makes an unreasonable offer, we are fully prepared to issue proceedings and represent you at trial.
- What if I was partly at fault for the accident?
If you were partly at fault, your compensation may be reduced proportionally. This is known as contributory negligence. It does not prevent you from bringing a claim, and we will advise on how any contributory negligence is likely to affect the amount you recover.
- How long does a personal injury claim take?

- Can I claim even if I still work for the employer who caused my accident?
Yes. You have the legal right to make a personal injury claim against your employer without fear of dismissal or other adverse treatment. It is unlawful for an employer to penalise you for bringing a legitimate claim. The employer’s liability insurer handles the claim, not the employer directly.
- What is the difference between a personal injury claim and an accident at work claim?
An accident at work claim is a type of personal injury claim, but the defendant is your employer rather than a third party. Employers have specific duties under health and safety legislation, and a breach of those duties can found a claim independently of general negligence principles.
