Family Law: Financial Remedies

Our client was the Applicant, applying for a financial remedy from the court. Initially, we obtained instructions from our client on the status of his divorce. Both the Decree Nisi, or conditional Order, and Decree Absolute, or final Order, had been granted. This meant the only thing for us to deal with was the financial remedy following divorce. We were instructed to prepare the D81 form and obtain a Clean Break Order on behalf of our client. Our client had 2 children from this previous marriage; however, child arrangements had already been made in this case.

Following discussions between the parties, they had both decided they wanted a clean break of finances. Rohana Khan, our family law solicitor, began completing the D81 form and drafting a Clean Break Order. The D81 form breaks down each party’s finances and provides complete transparency as to income, property and any other assets. Each party completes a D81 form, which are usually combined onto one form and enclosed with the Clean Break Order. The Order itself states the facts of the divorce and that both parties wish to have a clean break in respect of all income, capital and pension claims. This Order is then signed by both parties and sent to the Court for a Judge’s approval. In this case, the completed D81 and Clean Break Order were drafted by Rohana, approved by the client, submitted to the Court and sealed by a Judge in a matter of two months.
